Oshkosh police officer will not face charges for suspected fatal stabbing

Oshkosh, wis. (WBAY) – Winnebago district lawyer has decided that an Oshkosh police officer will not face criminal charges for shooting a suspect stabbed in December.

Deputy District Lawyer, Tracy Paider, wrote in the decision that the use of the deadly force was justified. “Regarding the severity of the crime in question, Fairman’s actions, words and conduct in this incident were extremely dangerous … threatening and could have been lethal.”

On December 10, 2024, the police responded to a 911 call about a stabbing on W. 10th Ave. The officers found a young woman outside with several stabbed wounds. She said she went to take her clothes, and the subject, now identified as Delveon Fairman, had a knife. She also told Fairman police stabbed it.

Police, learning that there could be another victim inside, entered the house with ballistic shields. Fairman climbed the stairs with what was described as a “big model”.

The police ordered him to give up the knife, but he continued to advance. An officer pulled a shot that hit Fairman in the torso, causing him to fall on the stairs, but he got up and the officer pulled a second shot.

While the officers started life rescue efforts, they found a second woman with stabbed wounds locked in a bathtub.

The police wore body chambers, and the shooting was investigated by the State Division of Criminal Investigation (DCI), as provided by the law of the state.

The officers involved were on administrative leave in accordance with the department’s policy.

The DCI investigation suggests that Fairman was under the influence of psychedelic fungi, which he drank in tea about four hours earlier that night.

A woman says that around 10:30 Fairman entered her room and asked, “Where is my mother?” He also said he went out to take him and she was the devil and then he took a knife. He said that the people in the house are bad and want to kill him.

One of the stabbed victims and grabbed the child and threw it on a window shortly before the officers arrived.
