The Delhi police moved the High Court of Delhi on Tuesday, challenging a court decision, rejecting his pleading on the issue of providing the list of unlawful documents to Bibhav Kumar, the close help of former Chief Minister Kejriwal and accused in the alleged cause of Swati Maliwal.

The Delhi police imposed an order adopted by a court of session on January 29, rejecting its request challenged a judicial decision of a magistrate who guides it to provide the list of unlawful documents to Kumar.

Appearing at the Delhi police, the permanent lawyer, Sanjay Lao, claimed that the judicial order of the sessions is bad in law. He said that, since a bank of 3 judges of the Supreme Court is confiscated on the issue of providing the list of unrighteous documents, the court should wait for the mentioned decision.

At the court’s question, Lao claimed that, on the date, the law on this topic is on “both sides” and that the list can be provided if the Supreme Court concludes that the same thing should be given to the accused.

In this regard, the court noticed orally: “Sometimes, what is happening is, the Supreme Court could take some time to decide a problem, and the problem has been left for some time, in such a situation we must go by law what is now predominantly. Quote the law on both sides. Make a case for residence. “

Lao then said that the decision Kumar made to request a list of unrighteous documents regarding most cases regarding the Central Investigation Bureau (CBI) and the interpretation of the CBI manual, which is not similar to the Delhi Police.

Then, the court noted that the CBI manual will not go over CRPC and that even in the CBI issues, the procedure is governed by CRPC.

The problem will now be heard on March 11th.

In September last year, Kumar received bail by the Supreme Court.

Initially, Kumar moved the court for bail, but he refused the exemption on May 27, 2024. His second ordinary bail was rejected by the Court of Session on June 7, 2024.

Agravated, Kumar was then brought to the High Court of Delhi, however, a bank chaired by Judge Anoop Kumar Mendiratta rejected his advantage of bail, noting that, although he is only designated as a personal secretary for the chief minister, he gives a considerable influence.

The judge said that, in the current stage, it was not able to exclude that witnesses can be influenced or the evidence can be modified, if Kumar is released on bail.
