The Dharwad Bank of the High Court of Karnataka recently refused to grant Rafiq, accused of sexually abused by a married womanillegally limited and constraining it to convert to Islam.

Rachaiah justice, while rejecting the pleading for bail, called the actions of the accused/appellant “not allowed” and mentioned that “forcing men or women to convert from one religion to another is a serious problem and a strict action is required in such cases.”

The court heard a appeal filed in accordance with section 14 (2) of the scheduled castles and the scheduled tribes (atrocities prevention) against the judge of the district judge and additional sessions, Belagavi.

According to the criminal prosecution, the applicant, a married woman leading a grocery store with her mother-in-law, claimed that the accused, Rafiq, frequently visited the store and made her friends. He promised that he promised that he would help her safety through her political connections, gradually developed a relationship with her and hired in sexual relations with her.

The woman’s husband eventually learned about the relationship, which led to conflicts between them. Later he left his husband and moved with his parents. However, Rafiq would be blackmailed to continue his relationship. She stayed with him for four months before moving to a rented house, where she was accused of raping her.

The action sheet also argued that the accused arranged for a woman to monitor the victim’s movements and press to convert to Islam and marry him. On April 15, 2024, her husband found it, after which he filed a complaint with the police.

In his plea, the accused claimed that the victim was a mature lady who volunteered with him for several months without any complaint, indicating a consensual relationship. It was also argued that its subsequent custody was not necessary, because the action sheets have already been deposited.

However, the applicant opposed the plea for bail, claiming that, if the bail is granted to the appellant, he would threaten the witnesses of the criminal prosecution and would prevent the judicial procedures.

When examining the contents of the parties, the Court stressed that the accusations are serious and required a strict legal intervention. He mentioned: “When the charging sheet statements, it seems that the appellant here limited the victim, keeping a woman to follow her movements and forcing her to convert to Islam.”

The court emphasized the need to ensure the victim’s safety and the proper conduct of the process and came to the conclusion that “it is not necessary to give the appellant’s bail until the victim’s evidence is completed.”

Consequently, the appeal was rejected, and the accused was ordered to remain in pending judicial custody.
