Pawnee County – a kind of Kansas will spend the rest of his life in prison for sexual crimes that involve minors.

On Wednesday, James Edwin Speer, 33, former Larned, appeared in arrest in front of the district of Pawnee County, Bruce Gatterman, for conviction, according to Pawnee County, Doug McNett.

In July, a jury found that Speer was found to be guilty of the rape of a child under 14 and the aggravated oral sodom of a child under 14 years.

It is assumed that the crimes took place in a residence in Garfield, Kansas, about 25 or 26 in 2013.

The testimony was presented at the trial that, during a discussion with her mother, in August 2020, the victim revealed that, when she was about 8 years old, she was sexually assaulted at the party, her father took it. The department of the sheriff in Pawnee County was then notified of the charges by the mother. A formal forensic interview of the girl was conducted by the Great Bend, Kansas Children’s Advocy Center.

At the trial, the defendant presented an Alibi defense arguing that it was impossible for him to have committed the alleged acts, because he was with another girl at that time. As part of the trial evidence, the parties stipulated that, in 2015, a sentence -convicted jury, from two accusations of indecent freedoms aggravated with a 14 -year -old child. Specifically, the jury found that Speer had sex with a 14 -year -old in a Larned apartment in May or June 2013; And he had sex with a 14 -year -old in a Larned apartment in June 2013.

Based on the age of the victim, according to Jessica’s law, the presumptive sentence was a life sentence with a mandatory requirement, the defendant fulfills at least 25 years. As part of his opportunity to address the court to conviction, Speer denied that he committed the recently convicted offenses and asked the court to consider the efforts he made in prison to reform and sentence him to a reduced sentence, so that he could be released in 2027.

The lawyer of Pawnee County, Douglas McNett, claimed that, based on the other previous sexual violent crimes, the court should find that Speer is an ordinary sexual offender aggravated and convicted of the defendant, without the possibility of conditional freedom.

After examining the investigation report of the present and heard the arguments presented, Judge Gatterman agreed with the state that Speer met the legal criteria of an ordinary sexual offender, being convicted for at least two previous violent sexual crimes. As such, the court sentenced the defendant to life in prison, without the possibility of conditional freedom. The defendant will also be subject to the registration of criminals for life as a sexual offender.

In accordance with the laws regarding the conviction in Kansas, all previous convictions that appear before the conviction in the current case are taken into account in determining the criminal history, regardless of whether the crime that led to the previous conviction took place before or after the current crime or the conviction in the current case.

Speer is currently in the custody of the Kansas Corrections Department, who executes a conviction for his convictions of sexual offenses in Pawnee County of 2015. Following the sentence, the defendant was advised on his rights to challenge the convictions and the sentence imposed.

The Court previously denied the defense motion for a new trial at a hearing made on August 22, 2024.
