The US man illegally accused of strangulation released after Fairfax County cuts the Pleading Agreement

Fairfax county, va. (7News) – The lawyer of the Commonwealth of Fairfax, Steve Descano, in a plea agreement, gave up an accusation of crime against Wilmer Osmany Giron for suffering a woman in exchange for a guilty plea to mark a model/blade in January, which is a crime, according to the judicial documents.

The man faced a 360 -day prison sentence and has a two -year disposition for an attack and a battery of a family member accusation, which is a crime, according to the judicial documents.

Initially, the accusations that Ramos Giron faced in January 2025 were the abduction by strength, strangulation and attack on a family member, they showed the court documents.

After the alleged strangulation, the victim filed an emergency protection order (hero) against Ramos Giron and was granted by the court.

According to Hero from 2025, Ramos Giron took the woman’s keys, preventing her from leaving and asked him to enter his car. Ero said as he was inside, Ramos Giron placed two hands on his neck, preventing his air and held a knife over her, according to the victim.

On January 27, 2025, an officer responded to an internal appeal, and Ramos Giron was accused of assaulting his ex-wife while quarreling, according to judicial documents.

The judicial documents said that Ramos Giron would have put his hand around his neck to strangle him, causing him to “be afraid to leave a knife” and “gave up on her feet.”

He wanted to see his children, said the judicial documents.

The victim also filed a hero against Ramos Giron in 2019, which was granted during the time he was accused of contributing to the delinquency of a minor and showed and marked a firearm.

Imigration and customs application (ICE) told 7News that Ramos Giron is illegally present in the United States.

• The officers issued Ramos-Giron an order to reinstall an previous removal order, the I-871 immigration form.
• The US District Court for the East Court of Virginia sentenced Ramos-Giron on July 12, 2019, for Alien in possession of a firearm and sentenced to 9 months in prison.
• ICE again eliminated Ramos-Giron on January 21, 2020, from the United States to Guatemala, following its release from the federal prison.
• On January 27, 2025, ICE learned about Ramos-Giron’s arrest by authorities in Fairfax, Virginia, for force, attack on one family member and suffocating another, causing injury. ICE submitted an immigration/notification prison against Ramos-Giron at the Adult Detention Center in Fairfax County.

On Friday, 7News addressed Descano’s office for comments on Ramos Giron’s case.

Descano’s office said in part 7News that Ramos Giron has faced a two -year protection order and must complete an assessment of mental health abuse and substance abuse and participate in an intervention program.
