A Bareilly court sentenced Ravi Babu Sharma on Tuesday, his wife Sharma, and his sister Radha Devi for life prison because he tortured and the brutal killing of his daughter Kajal, 10 years old Murder Talkar. The Court cited the decision of the Supreme Court of 2018 in Nupur Talwar VS State of Up, stressing that the reason should not be proved when there is direct evidence.

News18 reviews the case-one of the most sensational crimes of 2020-in which Kajal’s beaten body was found during the Covid-19 blockage. The body wore 15 wounds, including fractures and the throat of the slit.

Crime

In August 2020, when Uttar Pradesh, like the rest of the country, faced the challenges of Covid-19 blockage, the Bareilly district of UP was shaken by the terrible murder of a 10-year-old girl. The terrible crime took place in the Izzatnagar area, where the victim, Kajal, was brutally tortured and stabbed to the death by her stepmother, Sharma Ritu, with the support of her father, Ravi Babu Sharma, and her aunt, Radha Devi.

Bareilly police officials told News18 that the incident took place on August 22 at 2:00 pm, when Kajal, exhausted by household chores, was resting in her house. It is assumed that her stepmother hit her in front because she did not end her work. This led to an argument between the two, who climbed quickly. In a rage of anger, Ritu grabbed a knife and stabbed the young woman repeatedly -more than 15 times. Kajal’s body wore deep lacerations, and the pure brutality of the attack was evident from the medical -legal exam.

A police official said that after killing Kajal, Ritu, along with Ravi and Radha, sought to cover the crime. They decided to bury the child’s body in their own house, trying to wipe all the traces of the crime. However, the neighbors had long suspected that Kajal was mistreated. Subsequently, reports appeared that the child was frequently beaten with a cane and subjected to extreme cruelty by her stepmother. When it disappeared suddenly, the community became suspicious. Some of them, already disturbed by the violence in progress in the household, have decided to report it missing.

Kajal’s body is exhumant

By acting on the complaint, the police launched an investigation. After persistent interrogation, Ravi and Ritu confessed crime. With the approval of the magistrate, the officers exhumed Kajal’s body on August 23. The autopsy report confirmed that it had suffered an extended physical torture, with multiple fractures, internal injuries and stabbed wounds. Her intestines had been damaged so seriously that fecal matter spilled – a gloomy testament of the brutality she had endured.

Following their confessions, Ravi and Ritu were arrested, while Radha managed to run. The police recovered the crime weapon and intensified the efforts to catch the abundant aunt.

Trial and judgment

During the trial, the criminal prosecution presented convincing evidence against Ravi Babu Sharma, his wife Sharma, and his sister Radha Devi for the brutal crime of the 10 -year -old. The court was based strongly on the direct testimony of the eyewitnesses, medical -legal findings and evidence recovered to establish its guilt.

The additional district judge and sessions arguing Kumar Yadav, while pronouncing the verdict, quoted the decision of the Supreme Court 2018 in the Talkar Vs. State of Up and ANR, stressing that, in cases with direct evidence, the motive is not necessary. The judge stated: “The proof of criminal prosecution clearly establishes the crime beyond reasonable doubts. The brutality caused to the victim leaves no room for clemency. “

The case of criminal prosecution was significantly consolidated by the testimony of Radha Devi’s son. According to the governmental counselor of additional district (ADGC), Sachin Jaiswal, “the statement of Radha Devi’s son was crucial to fit the accused. He not only reported the crime, but also provided first -hand details about the accused who buried the body. “He said the court that Kajal resisted the presence of unknown men at their house, which could have upset his stepmother and aunt.

The court found that the used weapon, a knife, was recovered by the accused. “The large number of wounds and execution mode indicates premeditated cruelty,” the judge said.

After examining all the evidence, the court sentenced Ravi, Ritu and Radha to life imprisonment in accordance with the IPC 302 (kill) and 201 sections (causing the disappearance of the evidence) and imposed a fine of 30,000 RS.
