Inheritance dispute: The Bello’s justice daughter issues a 14 -day ultimatum for DNA tests on heirs

Ann Bello, the daughter of the late Judge Moses Abubakar Bello, the former president of the Court of Appeal in the habit of Abuja, issued an ultimatum of 14 days to the executors of her father’s will to perform DNA tests.

She warned that non -observance of the ultimatum will lead to criminal charges for violating confidence.

In a notification of February 26, 2025 and issued through his legal adviser, Victor Giwa, Ann referred to a recent decision of Judge Mohammed Zubairu from the High Court FCT, Kurudu.

The court decided that the codicil at the will of her father was not invalid, thus stating that the original will remains the only compulsory legal document regulating the estate.

Ann has previously challenged executors in court, contesting the distribution of her father’s properties.

In the number of costume CV/667/2024, she sued Father Ezekiel Awolumate and Christ the King Catholic Church, the parish of Okene, as the first and the second defendant.

She claimed that the first defendant applied a sharing formula of 4.16% instead of 11.11% stipulated by her regretted father. She requested a declaration of court confirming her right to a new (11.11%) of her father’s actions and actions and asked for the executors to be removed because they did not distribute the estate according to the will.

Ann also claimed that her father’s codicil has modified the original will.

However, justice Zubairu rejected her request, deciding that Codicil did not meet the legal requirements.

The judge mentioned that the document, labeled as codicil, was more similar to a private letter to the testator’s lawyer and did not have the signatures of the necessary witnesses.

Following the trial, Ann, in her opinion addressed to the revered Father Ezekiel Awolumate, the parish priest of the King King, Okene, insisted that DNA tests be performed as a precondition for the eligibility of inheritance under the will.

The notification wrote: “We are advised for Ann E. Bello, one of the beneficiaries and heirs of the honorable justice of justice Abu Moses Bello, hereinafter referred to as” Our Client “.

“It is the instruction of our client that, after death and reading the will of her late father, you, in collaboration with other members of Mrs. O. Bello, her stepmother, conspired to intentionally disintegrate her from her legacy.

“Following the court’s decision of February 5, 2025, by the honorable justice Zubairu, who declared the codicil as being legally invalid, the last will remains the only compulsory document.”

The notification also said: “According to point 5 (a) (I) of the last will of the Honorable justice Abu Moses Bello, a DNA test must be performed for Joseph Asuku Bello and six others. This test is a mandatory condition for their inheritance. If they fail to comply, they must give up all the amounts, properties and assets allocated.

“We will serve you a 14 -day notification to perform the DNA test or to provide a formal response that outlines steps to comply with the will.

“Notice that we will oppose any sales, transfer or relationship with any assets under the will.

“Note that non -compliance will result in criminal charges against you and any other affected party in accordance with the provisions of the will.”
