Justice K. Sujana, while rejecting the demand for the pre-largest bail, criticized the conduct of the petitioner Shravan Kumar, who abandoned almost a year, fled abroad after the wire was registered.

The judge observed that a person facing investigation or appointed in a file of action was obliged to obey the law authority and to request the remedies in accordance with the legal provisions, rather than to defy them. In addition, the judge also stated that granting anticipatory bail is an exceptional remedy that is exercised only in extraordinary circumstances and not as a matter of routine.

Sujana justice stressed that although the arrest should be the last option and should be resorted only when absolutely necessary, the main objective of an anticipatory bail is to prevent harassment or humiliation due to personal vend or in any given circumstances.

“At the same time, granting the anticipatory bail should not prevent the normal course of the investigation. Therefore, the preliminary bail must be exercised with caution, because it does not interfere and does not slow down the ongoing investigation ”, observed the Sujana Justice.

The Court argued that, in this case, taking into account the conduct of the petitioner and the severity of the levels level against him and applying the legal principles established regarding the anticipatory bail the petitioner is not entitled to a preliminary bail. There is no merits in this case, and the same can be rejected, she said.
