Martin ‘Viper’ Foley sued his own wife

Martin ‘Viper’ Foley sued his own wife

The new front opened in the battle of the High Court, while Sonya asks half of Foley’s house in Dublin

Sunday world He can reveal today that Sonya issued legal procedures on Monday, the High Court, calling Foley as a defendant in question.

Legal sources have confirmed the case in which Sonya-which is represented by the Roscommon, Staunton, Caulfield and Company-Sets legal company refers to the “legal and beneficial interest” in 114 Cashel Avenue, Kimmage, Dublin.

It is said to “request adequate statements from the court in relation to its interests.”

The property of Kimmage, the house that the couple shares with their nine -year -old daughter, is currently the subject of a Battle of the High Court, as the CAB is trying to sell it to set an income invoice of 1 million euros, which it says is due by Foley.

If Sonya Foley manages to have part of her declared property, she would see Cab’s efforts to sell the house locked endlessly.

On Monday, Sonya told a judge in the Civil Court of the Circuit that if the office is allowed to sell the property, she and her nine -year -old daughter will be left homeless.

Married

Foley, described as a 74 -year -old pensioner, is fighting Cab’s requests for holding his house to meet some of his long -term tax debt, which now totals almost 1 million EUR.

Cashel Avenue house in Kimmage

He said that he and his wife have lived together since they were married in 2013, a year before the decision against him.

The aircraft Keith Farry and John Temple, a lawyer for Foley and Sonya, told Judge Fiona O’Sullivan that Mrs. Foley was asking for half-action for what was her family’s home, while her husband offered weekly contributions for the outstanding debt.

Shaua Connaughton-Deeny, who appeared with the state applicant Emma Griffin for CAB, said that the decision against Mr. Foley has already been obtained, and the office was now requesting an order from 114 Cashel Avenue to facilitate its sale.

Judge O’Sullivan said he would judge next week.

The judge heard that while the sheriff participated in Foley property to confiscate personal goods and properties, only € 2,503 were erected.

The court heard that Mr. Foley was the registered owner of Kimmage property with his regretted wife, Pauline Foley.

A decision of 916,960 from the High Court of 916 EUR obtained by the CAB was made up of unpaid arrears on income tax and interest.

Foley says he is willing to engage in a mortgage scheme for renting by which CAB can sell the house, but would live with his wife and child and would make weekly or monthly contributions through a “payment plan”.

He indicated that he is also willing to hand over the cabin “the benefit of two defamation actions” he takes against BBC and Penguin books.

Business

Mr. Farry told the court that Mr. Foley was led to believe that the CAB and the income commissioners agreed not to follow him for the outstanding fiscal invoice of EUR 1, because he made an agreement with them.

He claimed that he said if he would not follow the Gilligan Charles Bowden gun for 120,000 euros, the CAB will not follow him for the tax debt.

Bowden, who is now in the witness protection program, was responsible for the weapons used by John Gilligan’s drug band and gave evidence against the former band chief and Brian Meehan in the special criminal court.

Meehan still executes a life sentence for the killing of Veronica Guerin.

Foley said that if he had received 120,000 euros, he owed when he won the case against Charles Bowden, he would have given this to the Criminal Assets Bureau and this would have been “a long road”, with the additional contributions to pay the initial debt of 178,000 euros.

He said that his house is not the receipts of crime.

His wife, who is in social well -being, claimed that she is not responsible in any way for the debt due to CAB and stressed that the home was her home and the only property.

Disability

“There is no reality to buy another house,” she said in written evidence. “The eviction would make my daughter and I am homeless.”

Mrs. Connaughton-Deeny told the court that no explanation was provided about why Sonya Foley could not work.

“She says she is on the handicap, we have no evidence in this regard, their evidence is vague and naked in the best case,” she said. “We have no evidence of bank accounts or other assets that they can have, how do they all survive without income? There is nothing to say anything in front of the court, ”she said.

Martin Foley has over 60 previous convictions, including for assault robbery and weapons. He was part of the criminal band led by Martin Cahill, who was known as a general and survived several attempts in his life.

Mr. Farry said that Mr. Foley was led to believe that his fiscal debt will not be pursued and now, after all these years, he was “unfair and disproportionate.”
