In the early morning of August 6, 2022, Fitzgerald was driving in a car near the Delta Park in North Portland, with his girlfriend and a man named Otis Abner.

According to investigators, Fitzgerald and Abner started arguing and, as the argument climbed, Fitzgerald told Abner to get out of the car near North Schmeer Road and North Whitaker.
