Seremban: A former 34 -year -old cement truck driver has been sentenced to eight years in prison by the High Court here for murder, in the death of his four -year -old stepdaughter.

Judge Rohani Ismail ordered Abu Hassan Darus, who was initially accused in accordance with Section 302 of the Criminal Code for murder, to execute the sentence of his arrest in February 2021.

“The Court finds that the defense team has successfully proved that the accused had no intention to kill the victim, as provided in section 304 (b) of the Criminal Code.

“After taking into account the mitigating factors in the defense and the aggravating factors by the criminal prosecution, the accused is sentenced to meet eight years in prison from his arrest,” she decided.

Section 304 (B) states that criminals can be closed up to 10 years or fined or both if the act is aware that it is likely to cause death, but without the intention to cause death or to cause such bodies that can cause death.

Abu Hassan was first accused under section 302 of the Criminal Code for murder in February 2021.

The accused was accused of killing Ummi Yusnani Sofel Herwan Norhadi between 15:00 and 17:00 at a house in Kg Halacara Baru Londah in Gemas on February 1, 2021.

A post-mortem examination found that the victim suffered multiple wounds, while dentists have confirmed that there are signs of bite on her body.

The suspect was arrested on February 9, 2021, after the victim’s brother told the police that she was often beaten by their stepfather.

In the mitigation, the lawyer of accused Kartikeyan was asked for a smaller sentence, because this was the first crime of Abu Hassan.

He said that the accused, who was the only winner of the family, must offer a child and four other steps.

“The law also gives discretion to the court to decide on the sentence, because there is no minimum punishment indicated in section 304 (b) of the Criminal Code,” he said, adding that this will also contribute to reducing overload in prisons, because a longer period of incarceration should be reserved for ordinary offenders.
