Bombay HC State questions about investigating Badlapur Full Meeting Case

In the alleged police meeting about Badlapur’s sexual aggression, accused Akshay Shinde, the High Court Bobay questioned how the state can make a probe without submitting a thread against the five responsible police. The state said that it is carrying out an “investigation” and not an “investigation” of the case, which it called as a “accidental death”.

A Bank of Justice Reached Mohite-Dere and Neela Gokhale on Thursday reserved the order for an Anna Shinde plea, claiming that his son was killed in a false meeting and sought the necessary action against the police. The bank named the main lawyer Manjula Rao as Amicus Curiae (friend of the court) to help after the parents sought to withdraw the petition.

The bank will decide whether the state should submit a wire in accordance with an investigation report presented by the magistrate, which keeps the five responsible police.

The main lawyer, Amit Desai, representing the state, said that CID runs an independent probe and a commission was formed by a retired chief judge of the High Court Allahabad to investigate the incident.

During the transit at Taloja prison, Shinde was shot by senior inspector Sanjay Shinde. The assistant police inspector Nilesh More, two Constanta and the police driver were also present in the utility vehicle at the time of fire exchange.

The police claimed that Shinde tried to snatch a firearm, forcing them to shoot. However, a Magisterial Investigation report on January 17 raised doubts, saying that the officers could control the situation and use of the force was unjustified.

Then, the court asked if an investigation can only be carried out on the basis of an accident death report. “We are worried about the wire recording. Where is that? Is the accident death report a thread? (When) … Later, it comes to the evidence that it was not an accidental or natural death, but a homucidal death, shouldn’t a thread be deposited? “The bank wondered.

When asked what CID proposed to do once his investigation is completed, Desai said that, based on the probe, CID will submit a closing report or a charging sheet.

Amicus said that once a magistrate report was presented, saying it was an “unnat and suspicious death”, the wire should be recorded.
