The term imprisonment suspended for mother for insurance fraud using fake identities – The Irish Times

A woman involved in a request for multgenerational insurance received a sentence with suspended prison.

Eileen Lawrence (52 years old), her husband Patrick (54 years old), and Tom (24 years old) and John (26 years old), who were children at that time, made bodily injury requests for road traffic incidents and falls using false names at the data between 2010 and 2016. The family have all addresses to Moyglas Glade, Lucan.

The family trained lawyers, participated in doctors and swore statements using false identities to follow the claims. Most applications have not succeeded, but a number were paid. The crime came to light after an insurance company hired a private investigator.

Another family member, grandmother Winnifred Lawrence (74 years old), was closed last year for three and a half years, with the last 18 months suspended because she made similar debts between 2012 and 2014. She fraudulently received EUR 23,150 after legal expenses.

Last Friday, Judge Martin Nolan imposed a two -year sentence on Patrick Lawrence and one year suspended sentences on Tom and John Lawrence.

Judge Nolan said there was no doubt that Eileen Lawrence was seriously involved in offense and thought it was worth going to prison. He said that the only thing that stopped him from such a conviction was the effect that the prison will have on third parties.

The court has heard that it is “the glue that holds the family together” and has had a care for the family members with additional needs. He said he would reflect last weekend in her case and impose sentence today.

Judge Nolan said the Lawrence family is “very working in the manufacture of fraudulent statements.” He said he was “very serious” to be wrong or to try to defraud the insurance companies. He added that the court could not ignore the potential impact on third parties. He imposed a three -year prison sentence to Eileen Lawrence, fully suspended, under strict conditions.

Last Friday, Judge Nolan said that Patrick Lawrence had his difficulties, but he was pleased to know mistakenly. He recognized his medical and mental health problems, but said this is a serious crime and imposed two years in prison.

He mentioned that Tom and John Lawrence were children at the time and there were some evidence that they were used as “pipes”, under some extent to commit crimes. The judge said that now he is doing well and that it would be unfair to closing them. He imposed punishments with one year suspended on both men.

Det Garda Ivor Scully from the National Bureau of Economic Crime Garda told David Perry Bl, criminal prosecution, that the family has submitted applications for bodily injury under false names to disguise all the previous statements. He stressed that some of the statements were paid, but most were not successful.

He said that an insurance company hired a private investigator to analyze certain claims, and the investigator took pictures with the family who participated in medical appointments under their false name. Gardaí was alerted and the investigation discovered the correspondence from the false identities to the accused persons and requested the money paid in a bank account of a family member.

The family was arrested and interviewed in 2019. Patrick Lawrence made four false requests under two false names for road traffic incidents and falls, with a single request, resulting in a payment of EUR 9,370. It has six previous convictions for theft and road traffic offenses.

Eileen Lawrence has made five claims under two false identities. Only one request was successful, 15,000 euros is paid in 2014. Another request was withdrawn after it was identified in court by Gardaí. Eileen Lawrence has no previous convictions.

Tom Lawrence made an unsuccessful request for a trip and fall in 2016 under a false name. He was 16 years old at that time. Has convictions for road traffic offenses and theft.

John Lawrence made four requests under false names, one being successful and eliminating a payment from EUR 6,155. John was also under 18 years old at the time of the crime. He has convictions for theft and road traffic offenses.

Roderick O’hanlon SC, the defense of Patrick Lawrence, said his client has a number of medical and mental health problems. He taught medical reports and said he was vulnerable to severe deterioration of his mental health.

He said that his client regrets the offense and has not offended since then. He asked the court to take into account his guilty plea, which avoided a difficult potential process.

John Berry Sc, the defense of Eileen Lawrence, said his client is “the glue that holds the family together” and was the main caretaker for a son with additional needs.

Hugh Hartnett SC, the defense of Tom Lawrence, asked the court to take into account the fact that he was 16 at that time. Now he is married and a father himself.
