The son of a Diplomat in Kenya, accused of sexually assaulted a five-year-old girl in a school bus in August 2023, left India with his family, after the Kenian government withdrew the diplomat from their post, the officials familiar with the problem said on Wednesday.

The departure comes almost 10 months after the alleged incident, which has aroused a complex legal struggle on diplomatic immunity.

The victim’s family expressed frustration to the result, claiming that the teenager targeted several children at school. “We were informed by the authorities last week that the accused and his family left India. This is deeply disappointing, as we think he has assaulted at least six minor girls,” said the victim’s father.

He added that the daughter “goes well” and changed school after the incident.

The Delhi police have registered a wire on September 19, 2023, according to section 10 (aggravated sexual aggression) of the POCSO law and section 75 (2) (sexual harassment) of Bharatiya Nyaya Sanhita. However, investigators hit a road block when they learned that the suspect was protected by the diplomatic immunity of a foreign send.

A police officer, speaking in anonymity conditions, said: “I sought permission through adequate channels in the Ministry of Foreign Affairs (MY) to question the minor, but the request remained pending due to the immunity protocols.”

People familiar with the problem said that the diplomatic immunity granted to a foreign diplomat also applies to their family.

The Indian part asked the Kenian government to renounce the diplomatic immunity for the diplomat in question, so that it can take measures against the son. However, the Kenian government chose not to give up immunity and, in contrast, chose to withdraw their diplomat and family from India, people said above.
