The High Court Kerala recently gave bail to a 25-year-old man, accused of attacking his mother, after refusing to give him money for New Year’s Eve.

While allowed the request for bail, the court, chaired by a unique bank, made up of PV justice Kunhikrishnan, expressed concern about the mental state of the young generation, stating: “There is no purpose to blame the young generation. Society and parents should follow them closely and monitor that their relationship is with good people. “

According to the criminal prosecution, the accused/ petitioner, Sammil, asked for money from his mother for New Year’s Eve. When he refused, he would have left the house, returned with a knife, and caused serious injuries on his head, face and hands, with an alleged intention to commit a crime. The petitioner was arrested on January 1, 2025 and accused in the sections 118 (1) (voluntarily challenging by any tool for shooting, stabbing or cutting) and 109 (attempted murder) in Bharatiya Nyaya Sanhita (BNS), 2023.

The court noted the alarming state of the mentality of the young generation, stating: “The mental state of our country is amazing and disturbing. Because he did not pay money for the celebration of the New Year’s Eve, the petitioner attacked his own mother and caused serious injuries. “

The court acknowledged the severity of the crime, but stressed that the guidance of society and parental is essential and said that only the young generation serves no purpose.

Initially, the court was reluctant to grant bail, unless the victim’s mother explicitly stated that she has no objection. Subsequently, the victim filed a statement that expressed her inability to see her son in prison. The court noted her statement: “As a mother, I cannot bear to see my son in prison.”

The bank, recognizing the victim’s emotional stress, said: “This sentence contains the tears of this unfortunate mother. I’m sure the wounds on her body might not have been cured. But her love for her son takes the wounds. Thinking the fate and trauma that mother faces, I am obliged to give bail to the petitioner. The love of a mother for her son is like a rose – she will bloom forever. “

In view of these observations, the Court found that “no purpose will be communicated by keeping this young man in detention, to continue his mother’s trauma.”

Finally, the court released the petitioner on bail after imposing strict conditions. Also, the court explained that any violation of these conditions would lead to the cancellation of the bail.
